Afghanistan war claims 2,000th US soldier, but pace slowing

The 2000th US soldier to die may have been the victim of another insider attack. Overall, the conflict has grown less deadly for US troops since 2010.

A possible insider attack has?claimed the life of America?s 2,000th soldier to die in Afghanistan. The shooting reportedly took place Saturday evening in Afghanistan?s volatile Wardak Province at a checkpoint run by the Afghan Army.

While initial reports indicated that the incident was likely an insider attack, international military officials now say insurgent fire may have been involved. The incident left one NATO soldier presumed to be American dead, along with a civilian contractor, and three Afghan soldiers. Afghan and international military authorities are now investigating the incident.

If confirmed as an insider attack, the incident is likely to carry particular significance beyond being the 2,000th American soldier killed in the nearly 11-year conflict. Though violence has fallen here with US troops seeing consistent drops in fatalities starting last year, the war continues to claim lives and this latest spate of insider killings presents a challenge that has so far eluded US and NATO efforts to solve the problem.

?It gets at the very core of trust between coalition forces and the Afghans, and it?s very difficult to counter,? says David Barno, a senior fellow at the Center for a New American Security who commanded US and international forces in Afghanistan from 2003 to 2005.

Citing findings that show insurgent infiltration accounts for only a quarter of insider attacks, with personal disputes accounting for another quarter and the rest having unclear motivations, Mr. Barno says stopping the attacks will be difficult.

?You can come up with a counter-intelligence program and take a number of other measures to help find Taliban infiltrators, but if three out of four attacks are related to cultural misunderstandings, outbursts, or friction perhaps related to 11 years of exposure between the coalition and Afghans that?s much more perplexing and much more difficult to deal with,? he says.

As US forces increasingly focus on the training mission ahead of the end of their combat operations, scheduled for 2014, the insider killings present a significant threat. If the most recent American death is confirmed as a so-called green-on-blue attack where an Afghan soldier kills an American service member, such incidents will account for 53 NATO deaths this year alone, or roughly 15 percent of those killed in Afghanistan.

NATO recently introduced severely restricted joint operations with Afghan forces in an effort to address the problem. But few Afghan units are judged by NATO as ready to operate alone, leaving some international forces on the ground looking to continue joint operations as a means of wrapping up the mission. Meanwhile, the most recent incident suggests that?efforts by Afghan and NATO forces to screen the fledgling security forces for possible turncoats will require still more work.?

?The recruitment of Afghan security forces was done mostly to reach the numerical goals, not to recruit quality soldiers,? says Hilaludin Hilal, a former deputy of the Ministry of Interior. ?The very urgent and short-term solution must come from the Afghan government. They must start screening and filtering these forces and kicking out anyone who poses a threat."

At the end of 2003, the Afghan security forces numbered just 6,000 personnel. Today there are 352,000, with the force nearly doubling in size between the summer of 2009 and now.

?Insider attacks, though tragic, will not derail ISAF from achieving its mission nor will it weaken the collective resolve and bonds of our Coalition and Afghan partners,? says US Air Force Major Lori Hodge, a spokesperson for the International Security Assistance Force. ?The partnership between Afghan and Coalition forces remains very strong and together we are committed to helping the people of Afghanistan build a prosperous future.?

Fighting in Afghanistan claimed the most American lives in Afghanistan in 2010, and since then the number of Americans killed here each year has dropped. Though Afghanistan has seen an overall reduction in fighting and violence, the decrease in NATO deaths may come in part from a greater focus on training Afghan security forces and a reduction in the number of international forces here. Just this month, the last US surge troops left Afghanistan, bringing the number of American soldiers here down to 68,000.

Counts for the death toll in Afghanistan vary based on different organizational counting practices. The Associated Press count, which now logs 2,000 dead, counts those service members killed inside Afghanistan during the course of the current war. Other counts include those killed in other countries working in support of anti-terrorism operations related to Afghanistan.

Are Syrian shells raining biological agents down on Lebanese?

Lebanese living along the Syrian border are reporting rashes and other ailments. They suspect Syrian biological weapons are to blame, although weapons experts say that is unlikely.

Residents in Nourat al-Tahta and other villages under routine Syrian shellfire are complaining of unexplained symptoms may indicate artillery shells have been filled with a biological agent, but weapons experts discount the panicky assumptions.

Nazir Shrayteh, a doctor from the nearby village of Dousi, says he has received an unusually large number of patients from villages under shellfire in recent months complaining of rashes and diarrhea.

?Since May we have been getting these skin problems,? he says. ?I don?t know what it is, but I feel something odd is going on.?

Still, biological weapons experts say that the chances are remote that biological agents in Syrian artillery shells are the cause of the ailments. Although T-2 mycotoxins, a chemical produced by certain fungi and used as a biological weapon, are said to cause both symptoms, they are extremely toxic and potentially fatal, says Kelsey Gregg, a former biosecurity specialist with the Federation of American Scientists.

?Even at low doses, there would likely be different symptoms from an?aerosol,?including?eye and respiratory problems,? she says.

Furthermore, the ad hoc pattern of Syrian shellfire does not suggest a determined attempt to deliver biological agents. Ms. Gregg suspects the blame lies with poor sanitary conditions due to the stressful, overcrowded and abnormal circumstances in which the local residents and Syrian refugees are living.

The Nourat al-Tahta residents' case bears some similarity to a recent incident in Afghanistan, when a group of schoolgirls showing symptoms of poisoning raised fears that the Taliban was poisoning the drinking water supplies at several schools. The World Health Organization dismissed the symptoms as more likely a form of mass hysteria ? something that has happened many times in history, the Monitor reported.

Bank profits rebounded in third quarter - The Term Sheet: Fortune's ...

FORTUNE -- It's good to be a banker, again. At least for now.

Profits at banks and Wall Street firms likely rebounded in the third quarter. Analysts are expecting that operating profits at nearly all the large banks and Wall Street firms will be up from the prior quarter and a year ago.

That's a change from the second quarter when the profit picture was mixed. Even ignoring JPMorgan's whole London Whale debacle, earnings were held down by a lack of deals, weak trading volume and a stagnant housing market. What's more, loans, the main source of revenue for banks, either because financial firms didn't want to lend or because borrowers were still nervous about the economy, were not increasing. Throw in all the reforms, and that left some worrying banks could no longer grow.? A number of firms announced layoffs.

All those things appear to be changing. While Wall Street remains slow, deal making made a comeback in September. In fact, it's likely that equity underwriting, that is selling shares of stock for public companies like AIG, which did a big offering recently, had its strongest month of the year.

Commercial and industrial lending appears to be growing much faster than usual - a good sign for the economy. And, at least for now, banks appear to be getting an added boost from Ben Bernanke and QE3. But the best news is that housing prices are rising again. That, along with lower mortgage rates, should translate into fewer foreclosures, which remain one of the biggest drags on bank profits.

Analysts expect operating earnings at Bank of America (BAC) and Citigroup (C) will be up 16% and 20% from the prior three months. Earnings per share at Goldman Sachs (GS) could also be up 20% from the second quarter.

"Banks are not hurting," says Dick Bove, an analyst at Rochdale Securities. "They are making a shitload of money."

Some question how long that will continue. The biggest wild card is the Federal Reserve's recently announced plans to buy mortgage bonds indefinitely. For now, that's been a bonanza. Mortgage bond rates, which is essentially what the banks have to pay to fund, these days from the government, home loans, have dropped much faster than actual mortgage rates, which is what consumers actually have to pay. That's opened up a huge spread between those two rates. It's nearly three times as large as usual, which essentially means banks are making nearly three times as much.

"Mortgage spreads are 80 basis points larger than there were just a few months ago," says Bove. "That's just pure profit."

Eventually, though, some worry that the Fed's relentless efforts to drive down interest rates, particularly if it lasts another year or so, will hurt the banks. Inflated mortgage rates are likely to be only temporary. More long-term is the fact that banks are going to be left with loans that are at substantially lower interest rates than the loans they made a few years ago.

What's more, while Wall Street firms are technically still allowed to do proprietary trading, that is making risky bets with their own money, at least for another year or so, Brad Hintz, an analyst at Sanford Bernstein, says it doesn't appear that many are. Instead, he said the firms are getting ready for a time when the regulations will likely significantly restrict what they can do with their money. That's held down trading profits. What's more, Hintz says the firms still aren't completely sure how much capital they need on hand to meet new requirements. That's made them gun shy with trading and lending as well.

"You are still going to hear plenty about expense controls," says Hintz. "It's not going to be a good story for those of us who rely on bonuses."

Despite the recent global economic crisis, the Islamic finance industry has continued pushing forward strongly. Entering 2012, the industry increased its total assets by 23.8 per cent by the end of 2011? comprising a hefty 22.4 per cent of the total assets of the banking system.

Global recognition has not been in short supply either as evidenced by The Banker Magazine?s 2011 rankings of top Islamic financial institutions which saw 21 Malaysian institutions listed.

?

By all appearances, Malaysia?s Islamic finance industry is well on its way?to fulfilling its aspirations to becoming an international Islamic financial centre.

Is it all hunky dory?

?

Missing element: ?The government should look into establishing a special court for Islamic banking,? says Datuk Ahmad Zaini Othman, Chief Executive Officer of the Malaysian Building Society Berhad (MBSB). ?This is something I think is still missing in this country.?

?If they want Islamic financing in Malaysia to be recognised internationally, they need to do this,? the CEO stresses.

?

Zaini points out that at present the legal aspects such as legal settlements still go through conventional courts. While the conventional judiciary may be familiar with Islamic financing law, Zaini stresses that we need judges who not only know the Islamic financing law but who also possess deep understanding of the religious aspects that go beyond laymen comprehension.

?

?It is all there in the Quran and Sunnah, but we need people who can correctly interpret them,? says Zaini, emphasising that ?interpretation is important.?

?

?For example, riba is not right and forbidden; however excessive profit, such as selling a property for 150 per cent profit, is wrong too.?

Mismatched avenue:?Zaini believes that continuing to rely on conventional courts for Islamic financing?s legal matters would be detrimental in the long run.

?

?Conventional court in itself is a mismatch,? says Zaini, clarifying that the word ?conventional? does not match with ?Islamic?.

?

?Because it is religion-based, at the end of the day we need to return to that essence and adhere to it,? says Zaini. ?That means having the necessary infrastructure to uphold it in a dedicated manner.?

?

What might happen if conventional courts continue to be used to deal with legal matters pertaining to Islamic financing?

?

?For one, you will continue looking at it through a secular way of thinking,? replies Zaini, adding that it may lead to oversight of some aspects based on Islamic principles. According to Zaini, another effect would be the stagnation of Islamic financing expertise in the country.

?

?One example is the musharakah mutanaqisah product ? this product is not feasible for properties under construction as some aspects of the law do not recognise certain parts of the transaction,? highlights Zaini. ?So if a developer goes ahead with the product, there is no protection for the developer under any law.?

?

The CEO further points out how the lack of protection in certain scenarios is limiting the industry. ?If you want to attract foreign Islamic investment in a big way, you need to have a strong Islamic legislative framework in place.?

?

?Foreigners would not come here and invest hundreds of millions if they are not protected,? Zaini emphasises. ?With a proper legal framework, we can do much bigger business.?

?

In addition, Zaini also points out that such a framework would also mean that the country would be more attractive to top talents in the industry.

If you do not have a very strong framework, you may not have a strong image of the Islamic platform,? says Zaini, asking rhetorically, ?why would an Islamic financing talent from the GCC (Gulf Co-operation Council) come to work in Malaysia if we don?t even have a court for Islamic banking??

?

?He would probably much rather go to GCC countries where the legislation is more developed in this respect.?

?

Challenging:?However, Zaini admits that putting in place a legal framework for Islamic financing would be challenging. Differing opinions and interpretations worldwide pose a daunting obstacle ? Zaini cites the introduction of Profit Equalisation Reserve (PER) by Bank Negara as an example.

?

?The Islamic deposit programme is based on profit and loss whereby banks pay dividends based on the allocated profits,? says Zaini, explaining that this means the dividends are higher if the Islamic banks make good profit and vice versa. ?In comparison, conventional banks pay based on a fixed amount of interest.?

?

?So when Islamic banks report good profits and subsequently pay more dividends than conventional banks, there would be a flow of customers from the conventional banking market to the Islamic financing market.?

?

Zaini explains further that PER was introduced to avoid the mass movement between markets by fixing the percentage of profit shared as dividends by the Islamic banks.

?

?Say they make profit and are able to pay 9 per cent, PER means they can only pay for example 4 per cent while 5 per cent would be kept in reserve.?

?

?There might come a time when the profit margin is smaller, in such an event, the reserve would be used to top up the dividends to be paid out,? says Zaini. ?The GCC is against this and do not recognise the practice because it is not in line with shariah.?

(However, Zaini feels the way forward would be to ignore the differences and focus on what can actually be done.

?

?Malaysia is heading towards a two-system financial system and for the Islamic part of it, we need a strong legal platform,? says Zaini. ?I think we have a sufficient pool of shariah legal expertise, and our universities are also producing enough experts in the area of Islamic financing.?

?

?But I think we also need to bring in scholars from abroad with a different perspective of the international market so that when we formulate the legal framework, it will be more comprehensive,? adds Zaini, explaining that doing so would enable Islamic financing in the country to reach greater heights.

?

?Like the English law, this will not happen overnight but instead through years of practice and experience.?

This is the thread where you introduce the ghostly ?servant? whom will come to serve your character throughout the roleplay, their profiles do not have to be so detailed as your primary characters, but I?d like them to have some felt depth to them. ^-^;; I?ll provide a basic skeleton to use in order to come up with your servants, but feel free to add to it if you want to, so long as you give the information in the default fields~

As for the history of our ?ghosts? here, well, they don?t have to have personal ones at the moment. The ghosts are souls who are bound to the house by choice, they came to be servants here of their own volition some ages ago. . . . Their role is to look after a single person, to offer to them comfort and advice, and to aid them in overcoming the problems which haunt them. As they take on the appearance of a face that holds some significance to the characters, their presence is a felt one. Their lives from before being bound to the house can be left ambiguous, unless you have some plans regarding that. The people they were before becoming bound to the house is entirely up to you?they can even be another gender than what they appear to be to the characters in reality.

They?re charmed to take on the appearance of a particular person, no matter the gender.

Personality: Celestine is a bit of an odd fellow?the life he led before becoming bound to the house is something he doesn?t much speak of, but his personality has not seemed to have changed much. He?s a rather joking sort, enjoying to poke fun at others until he gets a rise out of them. Even then, he?ll just laugh the outburst off. As far as he is concerned, he?s got nothing to really be afraid of, if someone tried to hit him, he could just phase through it. . . . So, really, he?s a jokester, someone who provokes others, seeming to not care really about what?s going on within a person?s head or heart, as he can really come off as an insensitive jerk. In truth though, Celestine is . . . deeper than that. It is very true that he can really seem unlikeable and rude with how he can come to taunt and tease others, but those are simply ploys he?s developed.

As far as he?s seen, sometimes the best way for someone to confront something that?s been festering within them is for that to be constantly poked and prodded at until, finally, it becomes notable.

So, his rather jerkish mannerisms are actually more of a fa?ade than they are real. Celestine is actually a rather competent soul, mature and levelheaded. He knows what he?s doing, and he understands more about people than he?ll let on. After all, he?s been bound to the house for so long now that he ought to know how to read people considering that the house has taken into itself more than a few people who were in dire need of help. . . .

The Reason They Look As They Do: Celestine has been bound to Amaryllis by a predetermined force?the house has deemed it so. Though the manor doesn?t speak, it sort of can convey what it wants and such to the souls bound to it. . . . And, from this, Celestine has come to be bound to Amaryllis, and as such, he has taken on the appearance of her deceased brother, ?Sterling.?

He has taken on this appearance because of the impact he had on Amaryllis? life. He was the primary source of love and all positive sentiments in her life until his death, and she associates her brother with solace, protection, and love. Given the fact that she?s held onto his memory for so long by dressing and melding his memory with her personality, he still has a very strong connection to her now. Celestine appears as him due to this.

Astronauts may play role in Mars robotic missions

WASHINGTON (AP) ? NASA's future plans to explore Mars may end up using astronauts as space messengers.

The new idea surfaced as a special team looking for a new Mars robotic exploration plan released a preliminary report Tuesday.

One of the option calls for a Martian robotic rover to collect rocks on the red planet. Later, astronauts in a newly built spaceship would be used to pick them up from a cosmic delivery point somewhere between Earth and Mars and return them home.

The report gives the space agency several options with no specific timing for future missions and no decision is expected until next year. The new plan is needed because budget cuts earlier this year killed two future robotic flights.

The space agency has so far explored Mars with orbiters and robots, like the rover Curiosity that landed last month. The ultimate goal has been to get a robot to collect rocks and Martian soil to send to Earth for more detailed scientific examination.

Separately, NASA is working on new missions for astronauts to explore away from Earth, with an ultimate goal of sending them to Mars sometime in the 2030s.

The NASA team proposed combining both dreams, getting astronauts involved in Martian exploration earlier. But they wouldn't exactly go to Mars itself. The astronauts would go somewhere between Mars and Earth and pick up the rocks left by a spacecraft that carried them off Mars.

That plan takes advantage of the new rocket and spaceship system for astronauts that should be ready in the next decade, said NASA associate administrator for sciences John Grunsfeld.

It also would lessen contamination worries about the Martian rocks. Scientists want to make sure that the Martian samples could not bring alien germs to Earth and that Earth organisms don't contaminate the Martian sample, Grunsfeld said.

And it would help the mission to land humans on Mars because it "looks a lot like sending a crew to Mars and returning them safely," Grunsfeld said.

The planning team looked at a few options for a Mars sample return mission:

?Send a bunch of spacecraft to Mars ? a rover, a launcher to return home, an orbiter ? in several launches.

?Package all those spacecraft into one or two launches that would save money but increase risk of failure.

?Send a bunch of small rovers to look around different spots of Mars to find the best samples and then design a system to collect and return those rocks.

Before that can happen, NASA still has to decide what robotic or orbiter mission it wants to send to Mars in 2018, if any. It's a time when Earth and the red planet will be close and save money on fuel costs. Grunsfeld said NASA only has about $800 million budgeted for that, which is not enough for a major rover.

U.S. cites three more countries for child, forced labor problems

WASHINGTON (Reuters) - The U.S. government on Wednesday added South Sudan, Suriname and Vietnam to its list of 74 countries where adults and children as young as 5 are subjected to serious labor and human trafficking abuses in prostitution, mining and other dangerous work.

The U.S. Labor Department's annual assessment of global human trafficking also raised concerns that the international economic crisis is slowing efforts to eradicate such child abuses by 2016.

"Just a few years from the deadline much remains to be done," the department said in a video accompanying its findings. "Great progress has been made, but with the global economic crisis those efforts have been scaled back, and that progress is now under threat."

Overall, the U.S. report cites 134 products from 74 countries tainted by child and other abusive labor. It said Asian countries, especially China and Burma, have relatively high numbers of goods made by forced labor.

Although it is difficult to track just how many children are exploited for work worldwide, the International Labour Organization put the figure between 980,000 and about 1.2 million in a 2005 estimate.

Overall, nearly 21 million people of all ages are victims, according to the Geneva-based organization, which is part of the United Nations.

The U.S. report follows new steps announced by President Barack Obama on Tuesday to fight human trafficking.

For the three newest countries, U.S. officials found labor problems over cattle in South Sudan as well as bricks and garments in Vietnam. In Suriname, gold mining and other work raised major concerns.

"Children in Suriname are engaged in the worst forms of child labor," one of the reports said. Those caught in mines face dangerous conditions such as mercury exposure, extreme heat and the risk of being crushed, it added, and child prostitution at mining camps is also a worry.

Products tainted by child and other abusive labor include shrimp, garlic, bricks and tobacco, among many others. This year, U.S. officials also added beef, fish and thread or yarn products.

'MODERN SLAVERY'

Labor abuses have long been a concern in certain industries such as farming and textiles, and 80 countries in 2010 pledged to fight for an end to the most egregious forms of child labor by 2016.

The number of children in the worst forms of labor has fallen worldwide, the Labor Department said in the video.

"But since 2005 the rate of progress has slowed considerably," it said.

Gayle Smith, a senior director at the National Security Council and a special assistant at the White House, said lower incomes and food insecurity are just part of the problem.

"Child labor .... has as much to do with tackling poverty from all angles," she said, adding countries need to work on policies to ensure families can earn a living wage so that children can go to school rather than work.

On Tuesday, U.S. President Barack Obama ordered stronger protections against human trafficking by prohibiting outside firms that work with the federal government from confiscating or destroying workers' documents and other similar actions.

The White House also required contractors to have plans in place to comply with such rules.

Such labor abuses "ought to concern every person, because it is a debasement of our common humanity," Obama told the Clinton Global Initiative in New York on Tuesday, citing the impact on society, financial markets, public health, violence and crime.

"It is barbaric, and it is evil, and it has no place in a civilized world," Obama said, adding that human trafficking "must be called by its true name -- modern slavery."

Some Republican lawmakers welcomed the administration's initiative but said the regulations did not go far enough and should criminalize labor abuses for work performed outside the United States by U.S. contractors and crack down on groups that receive U.S. grants.

The White House effort is "a half-measure policy," U.S. House Oversight and Government Reform Committee Chairman Darrell Issa said in a statement on Tuesday.

Since the iPhone 5 hit store shelves on Friday, complaints about the propensity of the?device's paint?job to scratch and chip have started flooding in.?But according to an email exchange Apple senior vice president of marketing Phil Schiller allegedly had with a customer such cosmetic issues are "normal."

According to?9to5 Mac's Seth Weintraub, one of the blog's readers sent an email to Schiller, pointing out that his iPhone 5 is showing "some scuffs, scratches and marks throughout the band around the phone."?He asked what he and others who are seeing this issue can do and whether there are any plans to fix it.

The reply Schiller sent, according to this customer, explained that "[a]ny aluminum product may scratch or chip with use, exposing its natural silver color. That is normal."

Schiller's somewhat brief?reply reminds us?of the time when late Apple co-founder Steve Jobs told a?customer who complained about the iPhone 4 reception issues he experienced when his hand covered the device's antennas that he should "[j]ust avoid holding it that way."

Of course, that email preceded what is now referred to as "Antennagate" and?a press conference during which Apple addressed these reception issues and offered every iPhone 4 owner a free "Bumper" case.

Just like the iPhone 4 reception issues reported back then, the cosmetic issues reported in the last few days?appear to only affect some iPhone 5 owners. NBC News tech?editor Wilson Rothman and I got the?iPhone 5 on the same day,?but while his is already showing wear (as you can see in the images above) after spending time in and out of his jeans pocket, my own device, also black, is still in pristine condition. And that's after it?spent a lot of time in a purse pocket along with other smartphones, loose change and my house keys.

Because of the strange way our experiences parallel the iPhone 4 reception woes, we can't help but wonder if we'll soon be hearing more on this,?possibly even from Apple, which has yet to reply to our inquiry. Given the fact that you can't upgrade hardware as easily as software (or maps), there's certainly a chance of a "Paintgate" in our near future.

Conservative group launches ad attacking Florida Supreme Court

TALLAHASSEE, Florida (Reuters) - A conservative advocacy group began running an Internet ad criticizing the Florida Supreme Court on Tuesday, days after the Republican Party started a campaign to sack three justices who rejected efforts to overturn President Barack Obama's healthcare law.

Americans for Prosperity, a conservative group financed by billionaires Charles and David Koch, released the first in an expected series of ads attacking the Supreme Court after the Republican Party of Florida executive committee voted unanimously to target justices Fred Lewis, Barbara Pariente and Peggy Quince.

The justices face a popular vote to remain in office this fall under the state's merit retention law, which was created in the 1970s to insulate the high court from political pressure.

"All three justices are too extreme not just for Florida, but for America, too," the Republican committee said in a statement announcing its upcoming effort.

The ad does not mention the justices by name but attacks the Affordable Care Act, saying the program is expensive and the law has been unpopular.

"That's why many states, like Ohio, gave their citizens the right to vote against it," the 30-second spot says. "Not Florida. Our own Supreme Court denied our right to choose for ourselves. Shouldn't our courts protect our rights to choose?"

A spokesperson for Americans for Prosperity did not immediately return a phone call for comment.

Slade O'Brien, president of AFP of Florida, told the Miami Herald/Tampa Bay Times: "We're not advocating for the election or defeat of any of the justices. What we're attempting to do is call more attention to them advocating from the bench."

In 2010, the three justices joined the majority in a 5-2 decision to reject a state effort to invalidate the heath care reform. Last year, the court also rejected a move by Republican Governor Rick Scott to circumvent the legislature in agency rulemaking.

The Florida Supreme Court has often been at odds with the Republican-led Florida Legislature and a series of Republican governors over the last dozen years.

In 2000, the three judges joined a majority of the court to order Florida election officials to recount ballots in the presidential election between Democrat Al Gore and Republican George W. Bush. That decision was overturned by the U.S. Supreme Court.

CONSERVATIVE AGENDA?

Critics of the recall say the efforts are less about judicial activism and more to do with a conservative Republican agenda.

"Let's make no mistake," said former state Senator Alex Villalobos, a moderate Republican from Miami. "That is what this is all about."

In 2010, voters removed three Iowa Supreme Court justices who were part of a decision that legalized same-sex marriage in the state. It was the first time members of that state's high court had been recalled by voters.

Created in 1976, Florida's merit retention system was an attempt to take politics out of the judicial nominating process following a series of embarrassing imbroglios involving high court justices.

Under the system, appellate judges and Supreme Court justices are appointed by the governor from a list of candidates submitted by a qualifications commission. While the justices do not face elections against rival candidates, voters are asked every six years to retain them.

If a majority votes against them, replacements will be appointed by the governor.

"The short reason why we have merit selection and merit retention for the appellate bench in Florida is that (the Supreme Court) was riddled with corruption all because of the politics that went into how they were selected," said Martin Dyckman, whose book "A Most Dishonorable Court: Scandal and Reform in the Florida Judiciary," chronicled judicial missteps that led to the merit retention system.

Another group, Orlando-based Restore Justice, was formed in August to target Lewis, Pariente and Quince for removal.

And another, Defend Justice from Politics, was established earlier this month to support the judges' retention efforts. The justices themselves have collectively raised more than $1 million to remain on the bench.

"The consequences of this retention election are not just the individual fates of these three justices but the fate for maybe a generation to come of the Florida Supreme Court," Dyckman said. (Additional reporting by Kevin Gray in Miami; Editing by David Adams and Jim Loney)
